We are a boutique internet and technology law firm with a wealth of high-tech clients ranging from early-stage start-ups to household names in the tech industry. While we are ideally looking for a dedicated law enforcement and surveillance attorney, multitalented attorneys who can handle that work and also counsel clients in one or more related areas of our practice (e.g., privacy, data security, transactions, gaming, marketing, e-commerce, and consumer protection) are also welcome and encouraged to apply.

The position requires a highly motivated, forward-thinking individual with the ability to work collaboratively as part of a team in a fast-paced legal environment. Although we achieve national accolades (e.g., Law360’s recent Practice Groups of the Year for Privacy and Consumer Protection), we’re not BigLaw: we want attorneys who share our creative and efficient team-oriented approach to clients’ needs, and who can serve as a valued strategic counselor — not simply bill hours. In-house experience is valued; part-time schedules may be accommodated for the right candidate; more experienced attorneys are valued and welcome.

The ideal candidate possesses the following:

The attorney will regularly assist internet service providers and application providers in handling requests for user data from third parties, including law enforcement, intelligence agencies, and civil litigants, on a global basis.

The attorney will work with our Law Enforcement and Surveillance team to help clients create and implement consistent policies, review individual legal process, interface with law enforcement, and handle disputes with law enforcement and third parties on behalf of clients, including briefing ECPA and surveillance issues in various types of civil and criminal litigation. The attorney will also assist clients with:

    • Managing compliance-related litigation involving motions to compel, motions to quash, and motions for protective orders
    • Pushing back on overbroad and inappropriate legal process and negotiating with prosecutors and third parties
    • Developing client-specific playbooks for responding to third-party data demands including response templates
    • Developing and ensuring consistent implementation of global and U.S. law enforcement compliance principles, policies, and procedures that allow clients to properly address applicable laws including surveillance laws, blocking statutes, and data retention
    • Representing clients before key external constituencies including law enforcement entities, other government agencies, congressional bodies, and other industry lead groups

Although ECPA is not the only law relevant to this position, candidates must be able to demonstrate aptitude and familiarity with interpreting and applying ECPA and related caselaw to the issue of whether particular forms of process are necessary or sufficient to compel production of particular kinds of data/records from particular companies.  It’s not the only thing we do, but that skill is an important building block for a lot of the other things.

This position is available in our DC, New York City, San Francisco, or Chicago offices. Remote work is also possible with periodic travel. Candidates must be barred in the jurisdiction in which they will generally work.

Candidates should write and communicate well, be able to think strategically and assess risks, and be comfortable working under tight deadlines that clients sometimes impose. Candidates should demonstrate the ability to independently manage projects, interact with clients, and work effectively as a team member.
